Medical Malpractice Can Happen Anywhere, Know Your Rights
Medical Malpractice Cases in Connecticut

Not every bad patient outcome, medical mistake or medical complication is caused by malpractice, but we will give you a free confidential case evaluation so you will understand your rights. Bob Messey, our doctor-attorney and Gayle Sullivan, our nurse-attorney will meet with you in the office or if it's easier, we will come to you. We will evaluate what happened, get the medical records, consult with medical experts, and investigate your case. When the investigation is complete, you’ll be advised of the results.

Prior to filing a lawsuit, the law requires us to obtain
a written signed opinion of a similar health care provider that there appears to be evidence of medical negligence.  We have an extensive network of medical experts that we consult with to determine whether a case has merit.  We are also required to file suit within the Statute of Limitations. In Connecticut, this is generally 2 years from the date of injury. If you think you have a claim, don't wait to call us.  A thorough investigation is critical to any malpractice case, and it may take months to complete.

The term “malpractice” has a specific meaning in the law. We must prove that a health care provider’s conduct has fallen below the professional standard of care, and this has caused you permanent harm. Health care providers who must act according to a professional standard of care include doctors, nurses, nurse practitioners, physician assistants, nurse midwives, chiropractors, physical therapists, dentists and others. We have handled cases involving a wide range of injuries occurring in a variety of settings. Some of the most common ones include:

  • Missed or delayed diagnosis of lung cancer, colon cancer, sarcoma and melanoma
  • Birth related injuries in children
  • Ambulance cases including delayed response and injury during transport
  • Anesthesia mistakes
  • Brain damage cases
  • Medication errors-wrong medication, patient mix-ups, wrong dose and overdose
  • Nursing procedures done incorrectly
  • Failure to supervise residents and medical students
  • Surgical mistakes, errors and post-operative complications
  • Wrong site surgery
  • Obesity surgery-serious complications and death
  • Missed or delayed diagnosis of stroke
  • Failure to admit to the hospital from Emergency Room
  • Pulmonary embolism due to no anticoagulant medication
  • Wrongful death
  • Premature discharge from the Emergency Room

One part of our investigation includes evaluating doctor's education, experience, credentials and lawsuit history. You can do this online at the Connecticut Department of Public Health License Verification website.    Doctors who are licensed in the state are required to complete the Physician Profile, which is published here.  In Connecticut, the Physician Profile contains information about the doctor’s education, post-graduate training and residency, disciplinary actions and malpractice payment history.  Payment amounts are placed into three statistical categories: below average, average and above average.

One thing you can do if you think you or a loved one has been harmed by medical malpractice, is make a list of all doctors and hospitals that were involved in treatment, along with the dates of treatment.  Keep copies of any paperwork that you have been given by any of these health care providers.  Have this information handy when you call to speak to Bob Messey or Gayle Sullivan and bring it with you to our meeting.

We work on a contingency which means there is no fee and you pay no costs unless we first obtain a recovery from those responsible. At McEnery Price Messey & Sullivan, you will have professionals on your side who understand the law and the medicine. With this combination we are qualified to represent people injured by medical malpractice throughout Connecticut.

If you think that you were injured by medical malpractice or negligence, we can help. Contact us today and we will start the investigation, preserve the evidence, protect your rights and help you to get the compensation you and your family deserve.
